1. General Conditions
1.1 This Return Policy applies to all purchases made from Whale Distribution B.V., located at Dr. Holtroplaan 19, 5652 XR Eindhoven, The Netherlands.
1.2 Returns are accepted only in accordance with prior written agreement and under the conditions described below.
1.3 As a B2B supplier, Whale Distribution B.V. does not offer returns based on change of mind, overstock, or unsold items. Returns are accepted only in the event of damage, defect, or incorrect delivery.
2. Notification of Return
2.1 The Buyer must inspect all goods immediately upon receipt.
2.2 Any claim for damaged, defective, or incorrect goods must be submitted to Whale Distribution B.V. within 24 hours of delivery.
2.3 Claims must include:
- A copy of the delivery note or invoice;
- Clear photos showing the issue (e.g., damage, labeling, or product defect);
- A brief description of the problem.
3. Return Authorization
3.1 No goods may be returned without prior written approval from the supplier.
3.2 Once a return is approved, the Supplier will issue a Return Authorization Number (RAN).
3.3 Returns without a valid RAN or prior consent will not be accepted and will be returned to the buyer at their expense.
4. Return Procedure
4.1 The Buyer must ensure that all returned Goods are:
- In their original packaging;
- Properly labeled and accompanied by all relevant documentation;
- Protected against further damage during transport.
goods4.2 Unless otherwise agreed, the Buyer shall bear the cost of returning the Goods.
4.3 Returned Goods must be sent to the address specified by Whale Distribution B.V. at the time of authorization.
5. Inspection and Outcome
goods.5.1 Upon receipt, Whale Distribution B.V. will inspect the returned Goods.
5.2 If the return is deemed valid, the Supplier will, at its discretion:
- Replace the defective or incorrect Goods; or
- Issue a credit note or refund for the amount paid.
5.3 Goods that do not meet the return criteria will be rejected, and the buyer will be notified accordingly.
6. Exclusions
6.1 The following goods are not eligible for return:
- Goods not reported within the specified time frame;
- Goods that have been used, altered, or damaged after delivery;
- Goods sold under clearance, special offer, or customized order terms;
- Perishable or time-sensitive items.
7. Liability
7.1 Whale Distribution B.V. shall not be held responsible for losses, delays, or damages caused by third-party couriers or external circumstances beyond its control.
7.2 The supplier’s liability for returned goods shall not exceed the value of the goods originally invoiced.
